ABOUT MR. BERNSTEIN

Alan Bernstein is a 1981 graduate of Nova Law School and has been a sole practitioner from 1984 to present, representing clients throughout the state of Florida.

Mr. Bernstein has been a member of the National College For DUI Defense since it’s inception.

IN 1995, Mr. Bernstein became a founding member of The National College for DUI Defense.

Mr. Bernstein is also a member of the National Association of Criminal Defense Lawyers and the Florida Association of Criminal Defense Lawyers as well as a Founding member of the DUI Defense Lawyers Association.

His firm’s practice is devoted almost entirely to DUI Defense. At any time he typically defends 60-70 DUI Cases in several jurisdictions. These cases range from a simple DUI to DUI’s with serious bodily injury and DUI Manslaughter cases which have penalties ranging from up to fifteen years in jail. 

Mr. Bernstein often defends cases where the breath alcohol result was well above the legal limit. He has won numerous cases where the client blew above the legal limit. Mr. Bernstein has caught numerous officers being untruthful and changing their stories on the stand as well as making numerous officers look like they did not know what they were doing.

He was one of the attorneys involved in suppressing numerous breath tests in Broward County Florida in 2005 and 2008.

He was also involved in recently suppressing numerous cases in Broward County Florida regarding the Intoxilyzer 8000.

Mr. Bernstein has taken and successfully completed courses in operating and maintaining the Intoxilyzer 5000.

He is also one of the only attorneys who has taken and successfully completed The Florida Department Of Law Enforcement courses on operating a breath test machine and maintaining a breath testing machine with regards to the new Intoxilyzer 8000.

He has lectured at several seminars including The National College For DUI Defense, wherein among other subjects he has lectured on cross examining a Toxocologist on blood test results in DUI’s involving serious bodily injury and death. He has also lectured in Florida on breath testing and maintenance of their Evidentiary machines as well as attacking the field sobriety tests. Mr. Bernstein has also instructed attorneys on defenses to illegal searches and seizures ranging from officers illegally stopping a car to detaining a person in a legally parked car.

Mr. Bernstein is currently a Faculty member of The National College For DUI Defense and the Florida state delegate for The National College For DUI Defense.

Mr. Bernstein has written a book for Lawyers and judges; published through Lawyers & Judges publishing company, entitled "Florida DUI Defense: The Law and Practice." This book is available to judges and attorneys throughout the state of Florida. He is currently working on the second edition of this book.
